In the context of ongoing discussions about possible measures to restrain the recession, AmCham Germany‘s Tax Committee sent a letter to the Chancellor and the Minster of Finance referencing the counteracting effects of selected fiscal regulations which, from our perspective, call for at least temporary revisions before the Bundestag elections.
This concerns the provisions about „Zinsschranke“ and the decline of accumulated deficits within transfers of shares („Mantelkauf“, 8c KStG, § 10 a GewStG), which make restructuring with „fresh“ equity from new investors considerably more difficult.
